In accordance with Art. 13(1) and (2) of the GDPR, OTSL Sp. z o.o. informs persons applying for employment or cooperation (international freight forwarders, drivers on the Poland–United Kingdom route and other roles) how their personal data are processed. Applications are made through the contact form with the subject “Careers” or by e-mail; a CV and other documents are sent by e-mail after the first contact. 1. Controller
The controller is OTSL Sp. z o.o., ul. Batalionów Chłopskich 71, 25-671 Kielce, Poland, entered in the register of entrepreneurs under KRS number 0001012523. No data protection officer has been appointed. For all matters concerning personal data contact info@otsl.pl or use the contact form.
2. Purposes and legal bases of processing
- Conducting the recruitment for the position you apply for, including contact by telephone and e-mail, the interview and the assessment of qualifications — Art. 6(1)(b) GDPR (steps taken at your request prior to entering into a contract) and Art. 22¹ § 1 of the Polish Labour Code, which defines the data an employer may request from a candidate: name and surname, date of birth, contact details, education, professional qualifications and employment history.
- Data beyond the scope of the Labour Code that you provide on your own initiative (for example a photograph, interests or family circumstances) — Art. 6(1)(a) GDPR, i.e. your consent expressed by sending them. You do not have to provide them; this does not affect the assessment of your application.
- Driver candidates: verification of the entitlements required for the role — category C+E driving licence, driver card, certificate of professional competence, experience of journeys to the United Kingdom — Art. 6(1)(b) GDPR in conjunction with Art. 22¹ § 1 of the Labour Code and road transport regulations.
- Participation in future recruitments — solely on the basis of a separate, explicit consent (Art. 6(1)(a) GDPR), which you may give in your application. Without it, data are deleted once the recruitment closes.
- Compliance with legal obligations of the controller, for example during an inspection by a competent authority — Art. 6(1)(c) GDPR.
- Establishing, exercising or defending legal claims connected with the recruitment process, and ensuring the security of IT systems — Art. 6(1)(f) GDPR (legitimate interest of the controller).
3. Retention period
- Applicant data are processed until the recruitment for the position applied for is closed and are then deleted — unless employment or a cooperation agreement follows, in which case the data become part of the personnel or contract file and are subject to separate rules.
- If you consent to participation in future recruitments, data are kept for 12 months from the date of application and then deleted. You may withdraw consent earlier.
- Data necessary for the defence against claims may be kept until the expiry of the limitation period applicable to the claim.
4. Recipients
Access to the data is limited to the persons conducting the recruitment at OTSL and to processors acting on our behalf under data processing agreements: the hosting provider of the website and contact form, and the e-mail service provider. Applicant data are not shared with other employers, employment agencies or job portals.
5. Transfers outside the European Economic Area
We do not transfer applicant data outside the EEA. Should the e-mail provider process data on servers outside the EEA, this takes place on the basis of standard contractual clauses adopted by the European Commission or an adequacy decision.
6. Your rights
- the right of access to your data and to obtain a copy;
- the right to rectification of inaccurate or incomplete data;
- the right to erasure and to restriction of processing;
- the right to data portability for data processed on the basis of consent or a contract;
- the right to object to processing based on legitimate interest (Art. 6(1)(f) GDPR);
- the right to withdraw consent at any time — without affecting the lawfulness of processing carried out before withdrawal;
- the right to lodge a complaint with the President of the Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warsaw, Poland.
Requests should be sent to info@otsl.pl. We respond without undue delay and at the latest within one month.
7. Voluntary nature of providing data
Providing data is voluntary, but within the scope of Art. 22¹ § 1 of the Labour Code it is necessary to take part in the recruitment — without these data we cannot assess the application or contact you. Providing additional data and consenting to future recruitments are entirely voluntary.
8. Automated decision-making
Applications are assessed by people. The controller does not take decisions concerning applicants based solely on automated processing, including profiling.
